Terms of Service

IMPORTANT MEDICAL WARNING

The neurogpt.pl portal is exclusively educational. Information generated by the AI assistant does not constitute medical advice, a diagnosis or treatment recommendations and does not replace a consultation with your attending physician, a neurologist or an epileptologist. In a sudden threat to health or life (e.g. a seizure lasting longer than 5 minutes) call for help immediately by dialling 112 (in Poland also 999).

§ 1. General provisions

1. These Terms of Service set out the rules for using the NeuroGPT educational portal available at neurogpt.pl (hereinafter: the "Portal"), including its installable web app (PWA).

3. The Portal is of an exclusively educational and informational nature. It does not provide medical services, medical advice or diagnoses. Its content concerns epilepsy and seizure disorders and does not replace a consultation with your attending physician, a neurologist or an epileptologist.

4. The Portal is not a medical device within the meaning of Regulation (EU) 2017/745 and the Polish Act on Medical Devices; it is not intended for the diagnosis, prevention or treatment of diseases.

5. Use of the Portal constitutes acceptance of these Terms of Service and of the Privacy Policy. The Portal may be used by persons aged 16 or over; a child's data is entered by their parent or legal guardian.

6. Technical requirements: a device with internet access and an up-to-date browser (Chrome, Safari, Firefox, Edge) with JavaScript and cookies enabled; for medication notifications — permission for notifications in the browser or in the installed app (PWA); for calendar synchronisation — a Google account. The Portal does not require installing additional software.

7. The contract for the provision of services by electronic means is concluded when an account is created and terminated when the User deletes it (§ 3(5)) or when the Foundation does so in the cases described in § 3(6). Using public content does not require an account.

§ 2. Nature of the portal and limitation of liability

1. NeuroGPT is an educational assistant based on artificial intelligence that provides educational information on epilepsy and seizure disorders.

2. Content generated by the AI assistant does not constitute medical advice, a diagnosis or therapeutic recommendations. Responses are generated automatically by a language model and may contain errors or simplifications.

3. In every health, diagnostic or therapeutic matter you should consult your attending physician, a neurologist or an epileptologist.

4. Training scenarios and clinical simulations available on the Portal are based on synthetic, fictitious data and serve solely as decision-making exercises.

5. The NeuroDzieci Foundation shall not be liable for health, therapeutic or legal decisions made on the basis of Portal content, including content generated by the AI assistant.

6. The Portal provides an epileptologist search tool — facility data comes from external sources and may not be up to date; please verify it before a visit.

§ 3. User account and registration

1. Registration is voluntary and free of charge. Some Portal content is available without an account; the AI assistant, the diary, the action plan and reminders require an account.

2. Registration requires a first name, an e-mail address and a password; the surname and — for the teacher and physician roles — the institution name or PWZ (professional licence) number are optional. The account is activated with a link sent by e-mail.

3. One account works on both of the Foundation's portals (neurogpt.pl and autyzm.neurogpt.pl); the scope of features depends on the chosen plan.

4. The User undertakes to provide true data and to protect the password against access by third parties.

5. The User may delete the account at any time in the profile settings. Deletion is irreversible and results in the permanent erasure of all data (Article 17 GDPR); a copy of the data (export) can be downloaded beforehand.

6. The Foundation reserves the right to suspend or delete an account in the event of a breach of these Terms of Service.

§ 4. AI assistant — rules for using the chat

1. The assistant answers on the basis of a language model and instructions prepared by the Foundation with reference to public medical and educational guidelines. Responses are general and educational in nature.

2. The free plan includes 1 query per day after creating an account; paid plans remove this limit and unlock specialist modes. The Foundation may apply technical limits (rate limiting) protecting the quality of the service.

3. It is prohibited to enter into the chat data identifying third parties (names, PESEL numbers, test results of specific patients). A carer provides their own child's data only to the extent necessary to obtain an answer; the child context from the action plan and diary is attached to the conversation only after this option has been enabled in the profile.

4. The assistant is configured not to provide drug doses and not to recommend changes in treatment. Attempts to circumvent the safeguards (jailbreak), automation of queries and use of the assistant contrary to its purpose are prohibited.

5. The conversation history is stored in the user account and may be deleted by the user at any time.

§ 5. Seizure Diary, action plan, reminders and sharing

1. The User enters into the diary and the action plan their own data or the data of a child of whom they are the parent or legal guardian, and is responsible for its accuracy. The Portal does not verify this data substantively.

2. Medication reminders, the stopwatch and notifications are auxiliary tools, not a medical device. Their delivery depends on the device, browser, system settings and internet connection; the Foundation does not guarantee delivery of notifications.

3. Sharing the diary or the action plan (e-mail invitation, link, QR code) takes place solely at the User's initiative; the User decides on the scope and may revoke it at any time. The person to whom data has been shared is obliged to use it solely for the purpose of caring for the child.

4. Synchronisation with Google Calendar is optional and requires the User to connect a Google account; it can be disconnected in the profile.

5. The Portal does not store photos or recordings. The "send to the doctor" feature transfers a recording directly from the User's device to the recipient indicated by the User.

§ 6. Plans and payments

1. The Portal offers a free basic plan and paid subscription plans (Educational PRO, Specialist PRO, School / Institution). Current prices and the scope of features are listed in the Pricing.

2. Payments are processed via Stripe — an authorised payment operator (PCI-DSS standard). The Foundation does not process or store payment card data.

3. Plan prices are quoted in PLN and include VAT in accordance with the applicable regulations.

4. The subscription renews automatically every month. The User may cancel it at any time in the profile ("Manage subscription") or by writing to the contact address — access remains active until the end of the paid period.

5. A consumer has the right to withdraw from a distance contract within 14 days of concluding it, without giving a reason. Pursuant to Article 38(13) of the Polish Act of 30 May 2014 on Consumer Rights (ustawa o prawach konsumenta), the User is not entitled to withdraw from a contract for the supply of digital content not supplied on a tangible medium if performance began with the Consumer's express and prior consent and the Consumer was informed, before performance began, that they would lose the right of withdrawal once performance was complete, and acknowledged this. Starting to use the subscription constitutes such consent.

6. The School / Institution plan includes a licence for the institution with the number of accounts specified in the offer; the licence administrator invites the institution's users.

7. Invoices are issued at the User's request.

8. The Foundation is liable to a User who is a consumer for the conformity of the digital service with the contract, on the terms set out in Chapter 5b of the Polish Act on Consumer Rights. Malfunctions of the Portal should be reported to kontakt@neurogpt.pl, stating the account e-mail address and a description of the problem. Making a report does not limit any rights conferred by law.

§ 7. Rules of use

1. The User undertakes to use the Portal in accordance with the law and these Terms of Service.

2. The following is prohibited:

  • Entering content that is unlawful or contrary to good practice
  • Attempting to circumvent the limits of the free plan and the safeguards
  • Automating queries without the Foundation's consent
  • Copying and redistributing Portal content without consent
  • Sharing login credentials with third parties
  • Entering third parties' data without a legal basis

3. Plans described as “unlimited” are intended for use by a single person — in the School / Institution plan, by one teacher on one seat of the licence. The Foundation applies a daily fair-use ceiling for the assistant, set above intensive use by a single person; exceeding it suspends the assistant on that account until midnight and does not restrict the remaining features of the Portal. The ceiling serves solely to prevent account sharing. If it is exceeded, the Foundation contacts the User and proposes a plan matching the actual pattern of use; persistent account sharing constitutes a breach of these Terms of Service within the meaning of § 3(6).

§ 8. Intellectual property

1. Portal content (texts, graphics, source code, knowledge base, document templates) is the property of the NeuroDzieci Foundation or is used under licence.

2. Content generated by the AI assistant and documents created in the generators may be used by the User for personal and educational purposes and in work with the person in their care; their commercial redistribution requires consent.

§ 9. Service availability and amendments

1. The Foundation strives to keep the Portal running continuously but does not guarantee uninterrupted availability; it reserves the right to technical breaks and modifications of features.

2. The Foundation reserves the right to amend these Terms of Service with 14 days' notice. Registered Users will be notified of material changes by e-mail; use of the Portal after the date on which the changes take effect constitutes acceptance of those changes.

§ 10. Final provisions

1. In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code (Kodeks cywilny), the Act on the Provision of Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną), the Act on Consumer Rights and the GDPR.

2. A Consumer may use out-of-court complaint and redress procedures (including the district or municipal consumer ombudsman and the voivodeship inspectorates of the Trade Inspection).

3. The court having jurisdiction over disputes shall be the court competent for the Foundation's registered office (Warsaw), subject to the mandatory provisions on court jurisdiction in consumer matters.
